Sale, payment and delivery conditions
The Santiago de Compostela University Press (SPIC-USC) offers in its web site the possibility to buy by selecting items through a virtual catalogue in which prices are indicated including VAT (retail prices). Items are compiled in a shopping basket in which the customer can add more items, eliminate items, modify the amounts of the selected items, and know the total price of the order at all times. Once the shopping basket is accepted, the pieces of data introduced in it constitute the object of the order, to which the delivery costs according to destination and weight of the total of the selected items are added. The customer is able to know, in a clear manner and with broken down data, the price of the order, the value of those taxes applied, and the specific delivery costs for his/her order.
The prices of the items shown in the web site of the SPIC-USC include the Value-Added Tax (VAT) that, if it is the case, applies. Those purchases that are to be delivered in territories of countries that are not members of the European Union, in the Canary Islands, in Ceuta or in Melilla are exempt from VAT. The SPIC-USC will not pay customs duties, duties, tariffs, special taxes or other expenses that apply on the basis of the country or place of destination of the order; all these will be payed by the addressee.
When making the order, the customer can freely choose to pay the purchases he/she makes by card (American Express, Mastercard, Visa, Visa Electrón...), bank transfer or cash on delivery. Payment with credit card is carried out through the payment systems contracted to a financial institution and under security systems of safe electronic commerce, systems that make sure the confidentiality of the data transmitted digitally at the moment of payment, which are based on SSL (Secure Sockets Layer).
The customer will have to take into account that delivery times, the quality of the service, the delivery place and the costs will be different for each form of transportation and will be specified in a manner independent of the product’s cost and prior to the order’s confirmation. The day of delivery at the customer’s address depends on the availability of the selected product and the delivery area, although it will not exceed 30 calendar days from the order’s confirmation and payment by the customer. Prior to confirm his/her order and proceed to payment, the customer will be informed on the delivery costs that apply to his/her specific order.
All orders effected are confirmed via e-mail, to the account specified by the purchaser during the purchasing process, with a copy of the order and invoice corresponding to the order. Each order has a unique identifier that can be used for any consultation about it.
Purchaser’s rights and conditions for return
The SPIC-USC dos not guarantee to its customers the availability or the inmediate delivery time of te products offered in its website, except for products in which a determined guarantee is expressly cited. The maximum deadline for delivery will be of 30 days. The catalogue that is shown is only illustrative. The SPIC-USC guarantees to its customers the possibility to cancel their order at any time and with no cost, as long as the cancelling is communicated before the order is made available to the shipping company for delivery.
The customer will have a period of fourteen days from reception of the order to terminate the contract and return the purchased product. The customer will communicate to SPIC in the stipulated time period and by any means offered by the law his/her wish to exercise the right to terminate the contract. The returned order will have to be delivered together with the delivery note and, if it is the case, the invoice that was issued. If the cause of the return were the fact that the returned product presents defects, the SPIC-USC will furthermore pay the costs derived from the return and new delivery of the product in perfect conditions.
The customer will be able to return any item that he/she has bought through the web site of the SPIC-USC as long as the products have not been opened or used and keep their original seal or packaging. In these cases, the SPIC-USC will refund the purchase money through a payment in the credit card, by means of a bank transfer to the account indicated by the customer or by means of a payment in his/her personal account, the customer having to pay the delivery and return costs of the products conforming the order.
If a product different from the product requested by the customer were delivered by the SPIC-USC, the wrong product will be retired from, and the right product delivered to, the customer at no additional cost for the purchaser. Customer’s obligations
The customer of SPIC is obliged at all times to provide truthful information about the data requested in the order form.
The customer is obliged to accept all the provisions and conditions established in the present conditions, understanding that they reflect the best will of service possible for the type of activity carried out by the SPIC-USC.
The customer is obliged to make the delivery of the requested order possible, providing a delivery address in which the requested order may be delivered in the usual time of delivery of goods (from Monday to Friday from 10:00 to 13:30). In the event of non-compliance of this obligation on part of the customer, the SPIC-USC will bear no responsibility for the delay or impossibility to deliver the order requested by the customer.
Applicable legislation and competent jurisdiction
The sale-purchases carried out with the electronic commerce of the SPIC-USC are subject to Spanish legislation. In the event of any conflict or discrepancy in the interpretation or application of the present contractual conditions, competent Courts and Tribunals will be those established by the applicable legal regulation. Sale operations will be understood to be carried out in the social address of the University of Santiago de Compostela. In the event that the purchasing part has its address out of Spain, both parts subject themselves to —with express renunciation to any other forum—, the Courts and Tribunals of Santiago de Compostela.
